Maryland SB 349, HB 428 Would Stop Medical Debt Property Liens

Maryland SB 349 and HB 428 would prohibit liens on owner-occupied residential property

A pair of bills are working their way though the Maryland Senate and House that would prohibit the creation of a lien on an owner-occupied residential property for the payment of medical debt. Maryland SB 349 and HB 428 are cross-filed bills going through the Senate and the House concurrently.

In addition to prohibiting liens on a person’s home, Maryland SB 349 and HB 428 define medical debt as, “a debt owed by a consumer to a provider of medical services, products, or devices, but does not include debt charged to a credit card except under certain circumstances.”

Maryland SB 349 is currently sitting in committee while Maryland HB 428 has passed three votes in the House with amendments and is now with the Senate. If either bill would be signed by Governor Moore, they would go into effect on October 1, 2025.
